OSHA Regulation Update: Upcoming COVID-19 Vaccine Mandate for Private-Sector Companies

President Biden announced his six-step COVID action plan on September 9, 2021. The plan involves requiring all employers of 100 or more employees to mandate vaccination or COVID testing for all employees. The Department of Labor's Occupational Safety and Health Administration (OSHA) is currently developing an Emergency Temporary Standard (ETS) to implement this vaccination mandate. OSHA is not required to allow opportunity for public comment or to allow for hearings on objections before issuing an ETS. When published, the ETS will serve as a proposed permanent standard.
